Eleven states and over sixty cities and counties have sued oil companies and other fossil fuel businesses for damage from climate change – mostly flood and wildfire damage. One of these cases, Boulder vs. Suncor, has reached the U.S. Supreme Court after going through lower courts. A full description of the case and some of the arguments of fossil fuel lawyers can be found here. The case involves issues of jurisdiction and standing, and it may not be decided soon. The U.S.. Supreme Court could remand it back to the state courts in the next few weeks, in which case it would come back to the U.S. Supreme Court again. This case exemplifies the issues raised by the introduction of the Stop Climate Shakedown Act (SCSA) by Harriet Hageman in the House and Ted Cruz in the Senate, which is the subject of a separate report here.
